Terms of Service

1. Acceptance of Terms By downloading, accessing, or using our mobile application ("theBrief," "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms constitute a legally binding agreement between you and Seedar Ltd ("we," "our," or "us").

2. Description of Service Our App provides users with tools to identify plants, diagnose potential plant diseases using uploaded photographs, and generate suggested treatment plans (the "Services"). We utilize third-party APIs (such as Plant.id) to process these images and provide diagnostic results.

3. Disclaimer of Warranties (Informational Purposes Only) You explicitly acknowledge and agree that:

  • Not Professional Advice: The plant identifications, disease diagnoses, and treatment plans provided by the App are generated by automated algorithms and are for informational and educational purposes only.

  • No Guarantee of Accuracy: We do not guarantee the accuracy, completeness, or reliability of any diagnostic results or treatment plans. You should use your own judgment before applying any chemical, biological, or preventative treatments to your plants.

  • No Liability for Plant Health: We are not responsible or liable for any damage to, or death of, your plants, pets, or property resulting from your reliance on the information provided by the App.

4. Subscriptions, Free Trials, and Payments We offer premium features through auto-renewing subscriptions.

  • Billing: All payments, subscriptions, and refunds are handled entirely by the Apple App Store or Google Play Store, depending on your device. We do not directly process or store your payment information.

  • Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.

  • Cancellations: You must manage or cancel your subscriptions directly through your Apple ID or Google Play account settings. Deleting the App or your account does not automatically cancel your subscription.

5. User Accounts and Security To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

6. User Content (Your Photos) When you upload photos of plants to the App ("User Content"):

  • Ownership: You retain all ownership rights to your photos.

  • License to Process: You grant us a worldwide, royalty-free license to use, transmit, and process those photos solely for the purpose of providing the Services to you (e.g., sending the photo to our diagnostic API and saving it to your digital garden profile).

  • Restrictions: You agree not to upload explicit, illegal, or irrelevant images that violate the rights of others or overload our servers.

7. Prohibited Conduct You agree not to:

  • Use the App for any unlawful purpose.

  • Attempt to reverse-engineer, decompile, or hack the App's source code or backend infrastructure.

  • Automate requests or scrape data from our APIs.

  • Share your Premium account credentials with multiple users to bypass subscription fees.

8. Limitation of Liability To the maximum extent permitted by law, Seedar Ltd and its partners, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or plants, resulting from your use of or inability to use the App.

9. Termination We reserve the right to suspend or terminate your account and access to the App at our sole discretion, without notice or liability, for any reason, including but not limited to a breach of these Terms.

10. Changes to These Terms We may update these Terms from time to time. If we make material changes, we will notify you via an in-app notice or email. Your continued use of the App after the changes take effect constitutes your acceptance of the revised Terms.
